Article 50 transparency requirements
Article 50 applies from 2 August 2026 to many ordinary AI products, whatever their risk tier.
Provider duties
- 50(1) Interaction: AI systems that interact directly with people (chatbots, voice agents) must be designed so people are told they are dealing with an AI, unless that is obvious from the context.
- 50(2) Synthetic content: systems that generate audio, image, video or text must mark outputs in a machine-readable format so they can be detected as artificially generated (watermarks, metadata, cryptographic provenance such as C2PA), as far as technically feasible. Under the AI Omnibus, systems already on the market before 2 August 2026 have until 2 December 2026.
Deployer duties
- 50(3): inform people exposed to emotion recognition or biometric categorisation systems.
- 50(4): disclose deepfakes, and disclose AI-generated text published to inform the public on matters of public interest, unless a human reviewed it and took editorial responsibility.
How and when
Information must be clear and distinguishable, provided at the latest at the first interaction or exposure, and must meet accessibility requirements (Art. 50(5)). The Commission is facilitating codes of practice on marking and labelling.
